Up to 33 States are preparing to face a joint lawsuit filed before the European Court of Human Rights by six young Portuguese. In a response that may have an important symbolic value, Strasbourg will have to decide whether there has been inaction on the part of the international community in the face of climate change and whether, if so, this inaction represents a violation of the rights contemplated in the European Convention. of Human Rights. The hearing takes place next week.
The six plaintiffs, Portuguese nationals between 11 and 24 years old , consider that the forest fires that have occurred in Portugal since 2017 are a direct consequence of Fax Lists climate change. They point out that the fire posed a risk to their health and that the heat waves lead them to suffer changes in sleeping patterns and have aggravated their allergies and respiratory problems . Two of the plaintiffs link climate change to particularly destructive weather events and point out that their houses, built near the sea, are at significant risk of being affected . They also claim to suffer permanent anxiety derived from natural disasters and the prospect of a future affected by progressive global warming.
They consider that the 33 defendant States, including Portugal, Austria, Belgium, Spain, Germany, France, Ireland, Denmark, Switzerland, Italy... and a long list that goes beyond the members of the EU, are failing in the fulfillment of its obligations with regard to compliance with article 2 of the European Convention on Human Rights (right to life), article 3 and article 8 (right to private and family life), interpreted in the light of the Agreements of Paris on climate change . They also believe that article 14 (prohibition of discrimination) is being violated, since the effects of climate change are especially harming new generations , on whose lives it will have a greater effect than on those of previous generations. In this sense, they also mention the UN Convention on the Rights of the Child.
